Terms of Use

Agreement Overview

These Terms of Use constitute a binding agreement between you ('Renter') and Prestige Drive Australia Pty Ltd ('Company'). By renting a vehicle from us, you accept these terms in full.

Eligibility Requirements

Minimum age 25 years (30 years for exotic sports cars); Valid driver's license held for minimum 2 years; No major driving offenses in past 3 years; Valid credit card for security deposit; Proof of Australian address or international travel insurance.

Reservation and Booking

Reservations require payment of deposit (typically 20-50% of rental value); Full payment due 48 hours before vehicle collection; Bookings confirmed via email with reference number; Vehicle availability subject to confirmation.

Payment Terms

All prices in Australian Dollars (AUD) inclusive of GST; Accepted payment methods: Visa, Mastercard, American Express; Security deposit held on credit card (AUD 2,000-10,000 depending on vehicle); Deposit released 7-14 days post-return subject to vehicle inspection.

Cancellation Policy

More than 14 days notice: Full refund minus 10% administration fee; 7-14 days notice: 50% refund; Less than 7 days: No refund; No-show: No refund.

Driver Responsibilities

Comply with all Australian road laws; No driving under influence of alcohol or drugs; Vehicle not to be used for: racing, off-road driving, driving lessons, hire/reward, illegal purposes; Maximum occupancy must not be exceeded; Only authorized drivers may operate vehicle; No smoking in vehicles (cleaning fee AUD 500).

Insurance Coverage

Comprehensive insurance included in rental price; Excess/deductible applies (varies by vehicle: AUD 2,000-10,000); Excess reduction options available at additional cost; Insurance void if terms violated.

Damage and Loss

Renter responsible for all damage during rental period; All incidents must be reported immediately; Police report required for accidents; Unauthorized repairs not permitted; Renter liable up to excess amount.

Prohibited Uses

Subletting or re-renting vehicle; Towing or pushing other vehicles; Carrying hazardous materials; Transporting more passengers than seat belts; Beach or unsealed road driving (unless approved); Leaving Australia; Carrying pets without authorization.

Traffic Violations

Renter responsible for all fines and penalties; Administration fee (AUD 50) applies for processing violations; Tolls charged to credit card plus administration fee; Parking fines are renter's responsibility.

Limitation of Liability

Company not liable for: Indirect or consequential damages; Loss of business or income; Personal property left in vehicle; Delays or breakdowns beyond our control. Maximum liability limited to rental amount paid.

Governing Law

These terms governed by laws of New South Wales, Australia; Disputes subject to exclusive jurisdiction of NSW courts; Australian Consumer Law rights apply and are not limited by these terms.
